Yatrasia Terms and Conditions

Welcome to Yatrasia! These Terms and Conditions ("Terms") govern your use of the Yatrasia website located at www.yatrasia.com (the "Website") and all related services offered by Yatraisa (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

Use of the Services

  1. You must be at least 16 years old and have the legal authority to enter into contracts to use the Services.

  2. You are responsible for maintaining the confidentiality of your account information and password.

  3. You agree to use the Services only for lawful purposes and in accordance with these Terms.

  4. You agree not to use the Services in any way that could damage, disable, overburden, or impair the Services or any server or network connected to the Services.

  5. You agree not to interfere with or disrupt the use of the Services by any other user.

Booking Services

  1. You are responsible for ensuring the accuracy of all information provided during the booking process.

  2. Yatrasia acts as a booking platform and does not own or operate any transportation services.

  3. We partner with various transportation providers to offer you a variety of options.

  4. The final terms and conditions for each booking will be determined by the specific transportation provider.

  5. Yatrasia is not responsible for any delays, cancellations, or other issues related to the transportation services themselves.

Payment

  1. Yatrasia uses Payway by ABA Bank - a member of National Bank of Canada, a secure payment gateway, to process your transactions.

  2. You agree to pay the full amount for your booking as displayed on the Website.

  3. All fees and taxes associated with the booking will be clearly displayed before you confirm your purchase.

  4. Yatrasia is not responsible for any fees or charges levied by your bank or financial institution.

Cancellations and Refunds

Cancellation by Customer:
  1. Customers may cancel their bookings by submitting a cancellation request to support@yatrasia.com.

  2. To be eligible for a refund, the cancellation request must be received by Yatrasia no later than 24 hours before the scheduled departure time.

  3. Cancellation requests received less than 24 hours before departure will not be eligible for a refund or any changes to the booking (including rescheduling or modification).

  4. Refund Options:
  5. Credit: Customers can receive a credit note for the full booking amount (excluding any banking fees). This credit note is valid for 6 months from the date of issue and can be used towards future bookings with Yatrasia.

  6. Cash Back: Customers can receive a cash-back refund for 70% of the booking amount (excluding any banking fees) reverted to the paying bank account (paying card). Please note that the processing of cash back refunds may take up to 30 working days.

  7. Cancellations by Yatrasia or Transportation Service Providers:
  8. In the event that a trip is canceled due to reasons beyond the customer's control, such as cancellation by Yatrasia or the transportation provider, Yatrasia will make every effort to provide the customer with a replacement service of comparable value.

  9. If a suitable replacement service is not available, Yatrasia will offer the customer a full refund of the booking amount (including any banking fees that are charged by Yatrasia’s bank). Please note that the processing of cash back refunds may take up to 30 working days.

  10. Claims for Compensation:
  11. To be eligible for compensation for a canceled trip caused by Yatrasia or the transportation provider, the customer must submit a complaint to Yatrasia via email at support@yatrasia.com.

  12. This complaint must be received by Yatrasia no later than 24 hours after the originally scheduled departure time.

  13. Complaints received after this timeframe may be rejected at Yatrasia's discretion.

Disclaimer of Warranties

Yatrasia as a Booking Platform:

Yatrasia is an online platform that functions solely as a booking facilitator by connecting you with Transportation Service Providers (TSPs) for your travel needs. We act as an intermediary between you and the TSPs.

Yatrasia's Scope of Responsibility:

Our responsibilities are limited to the following:

  1. Issuing Booking Confirmations: You will receive a valid booking confirmation upon successful reservation. This confirmation must be presented to the designated TSP (bus, private taxi, or ferry) upon arrival. The confirmation will detail your reservation specifics, including the TSP name, route, departure time, and any other relevant information.

  2. Cancellation and Refund Support: In the event of a reservation cancellation, we will provide support and process refunds in accordance with the cancellation policy outlined in our Cancellations and Refunds section (refer to the section above for details).

  3. Customer Support: Our dedicated customer support team is available to assist you during the following hours:

    • Monday to Friday: 7:00 AM to 8:00 PM (Indochina Time)

    • Weekends and Public Holidays: 8:00 AM to 6:00 PM (Indochina Time)

  4. Information Availability: We strive to provide you with the most current information available from our TSPs. However, please be aware that information may be limited depending on the specific TSP and unforeseen circumstances.

  5. Customer-Provided Information: Yatrasia cannot be held responsible for any issues arising from incorrect email addresses or contact numbers provided by the customer. This includes but is not limited to the non-receipt of booking information, updates, or other essential communication.

  6. Yatrasia's Responsibilities Do Not Cover:
  7. Travel Duration: While we provide estimated travel times based on TSP and driver experience, these are subject to various external factors such as traffic congestion, weather conditions, and road closures. Yatrasia cannot guarantee the exact duration of your trip.

  8. TSP Performance: We are not responsible for the TSP's actual departure and arrival times, employee conduct, competence, or absence. Additionally, the quality of amenities onboard (seats, Wi-Fi, toilets, air conditioning, etc.) is the responsibility of the TSP.

  9. Trip Disruptions: Yatrasia is not liable for cancellations, rescheduling, or changes made by the TSP. This includes last-minute modifications to seating arrangements or bus type.

  10. Passenger Responsibility: It is the passenger's responsibility to arrive at the boarding location on time, as specified in the booking confirmation email. Contact information for the TSP will also be provided in the confirmation for any location clarifications.

  11. TSP Station Changes: Yatrasia cannot be held responsible if a TSP changes its station without informing us.

  12. Booking Errors: Customers are responsible for reviewing their booking information for accuracy. If you identify errors, please notify Yatrasia support at support@yatrasia.com within 24 hours of booking.

  13. Immigration and Visa Issues: Yatrasia does not provide information or guidance on immigration and visa requirements. Please ensure you have the necessary documentation before your trip.

Our services are provided "as is" and "as available." Yatrasia makes no express or implied warranties regarding the services, including merchantability, fitness for a specific purpose, or non-infringement. We do not guarantee uninterrupted, error-free, or virus-free service. Additionally, Yatrasia does not guarantee the accuracy or reliability of any results obtained through our services.

Limitation of Liability

Yatrasia's liability in connection with the services is limited to the greatest extent permitted by law. This means Yatrasia, its officers, directors, employees, or agents will not be held liable for any damages arising out of or in connection with your use of the services, including:

  1. Direct Damages: These are the immediate and foreseeable consequences of a breach of contract or other wrongdoing.

  2. Indirect Damages: These are secondary or consequential losses that are not directly caused by the breach.

  3. Incidental Damages: These are relatively minor expenses incurred as a result of the main issue.

  4. Special Damages: These are unique losses specific to the situation.

  5. Consequential Damages: These are losses that are not a natural consequence of the breach but could have been foreseen under specific circumstances.

  6. Punitive Damages: These are intended to punish the at-fault party for egregious behavior.

  7. However, some jurisdictions may limit or disallow the exclusion or limitation of certain types of damages, such as personal injury or intentional misconduct. Therefore, the limitations above may not apply to you in their entirety.

    Yatrasia is not responsible for any damages arising from:
  8. Information provided by TSPs: We rely on information provided by TSPs and cannot guarantee its accuracy or completeness.

  9. External factors: Travel disruptions due to traffic, weather, or other unforeseen circumstances are beyond our control.

  10. Passenger actions: Yatrasia cannot be held liable for missed boarding times or other passenger-related issues.

  11. Your use of the services constitutes your acknowledgement of these limitations of liability.

Privacy and cookies

Please review our Privacy Policy for more info on privacy, cookies, and how we might contact you and process personal data.

Indemnification

You agree to indemnify, defend, and hold harmless Yatrasia, its officers, directors, employees, and agents from and against any and all claims, losses, damages, liabilities, costs, and expenses (including attorneys' fees) arising out of or in connection with your use of the Services.

Copyright and Intellectual Property

The Website and all content contained therein, including but not limited to text, graphics, logos, images, and software, are the property of Yatrasia or its licensors and are protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, or commercially exploit any of the content without the express written permission of Yatrasia.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Cambodia. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of the Kingdom of Cambodia.

Entire Agreement

These Terms constitute the entire agreement between you and Yatrasia with respect to the use of the Services.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

Changes to the Terms

Yatrasia reserves the right to modify these Terms at any time without prior notice. You are advised to review these Terms periodically for any changes. Your continued use of the Services after any changes to these Terms constitutes your acceptance of the new Terms.
